Terms of Service

These Terms of Service govern the provision of services by Business Sorted Kent. By engaging services, you agree to the terms outlined below.

1. Services

Business Sorted Kent provides digital marketing and creative services including but not limited to:

  • SEO and Local SEO

  • Website design and development

  • Branding and logo design

  • Social media support

  • AI and automation consultancy

  • Print and branded materials

Services are delivered as agreed in writing via proposal, email or contract prior to commencement.

2. Proposals and Agreements

All work begins following written agreement of scope and pricing.

Proposals outline:

  • Scope of work

  • Deliverables

  • Estimated timelines

  • Fees and payment structure

Any additional work outside the agreed scope may be quoted separately.

3. Payment Terms

Unless otherwise agreed in writing:

  • Invoices are payable within 14 days of issue.

  • Ongoing monthly services, including hosting and maintenance, are billed in advance.

  • Project work may require a deposit prior to commencement, with the balance due upon completion or at agreed milestones.

Where hosting, platform subscriptions, domain management or maintenance are included within an ongoing package, these are covered by the agreed monthly fee.

Failure to make payment may result in suspension of services, including website access, hosting or management.

4. No Guaranteed Rankings

SEO and digital marketing services aim to improve visibility and performance. However:

  • Search engine rankings cannot be guaranteed.

  • Search engines control their own algorithms and indexing processes.

  • Results depend on competition, industry and external factors.

Business Sorted Kent provides structured, ethical optimisation but cannot guarantee specific positions or traffic levels.

5. Client Responsibilities

Clients agree to:

  • Provide accurate information

  • Respond to requests for feedback in a timely manner

  • Supply required content, imagery or approvals

  • Ensure they have rights to any materials supplied

Delays in providing required information may impact timelines.

6. Intellectual Property

Upon full payment:

Clients retain ownership of final approved website designs, branding assets and deliverables unless otherwise agreed.

Business Sorted Kent retains the right to:

  • Display completed work within its portfolio

  • Reference completed projects for marketing purposes

Third party platforms such as Wix, Shopify or hosting providers remain subject to their own terms.

7. Hosting, Platform Management and Third Party Services

Where a website is hosted or managed through third party platforms (including but not limited to Wix, Shopify and domain providers), Business Sorted Kent can manage the platform setup, configuration and ongoing maintenance as part of an agreed service.

This may include:

  • Hosting and platform configuration

  • Domain and DNS management

  • Routine updates, monitoring and maintenance

  • Plugin or app configuration where applicable

  • Liaison with third party support where required

Business Sorted Kent is not responsible for outages or failures caused by third party providers, but will take reasonable steps to investigate issues, communicate updates, and support resolution on the client’s behalf.

Where platform subscriptions, licences, domains or hosting fees are billed directly by third parties, the client remains responsible for ensuring those payments remain up to date unless explicitly agreed otherwise in writing.

8. Ongoing Services and Cancellation

For monthly services, including hosting and maintenance:

 

Either party may cancel with 30 days written notice unless otherwise agreed in writing.

Where cancellation occurs:

  • Websites can be transferred to the client or a nominated third party upon request.

  • Transfer may be subject to reasonable administrative or migration fees depending on platform and complexity.

  • Hosting and maintenance cease once the notice period ends.

All outstanding invoices must be settled prior to transfer of files, access or credentials.

9. Liability

Business Sorted Kent shall not be liable for:

  • Loss of business, revenue or profits

  • Indirect or consequential loss

  • Search engine penalties arising from client supplied content

Total liability shall not exceed the fees paid for the service in question.

10. Confidentiality

All client information shared during projects will be treated as confidential unless disclosure is required by law.

11. Amendments

These terms may be updated periodically. The latest version will be available on this website.

12. Governing Law

These terms are governed by the laws of England and Wales.
